Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Enzonic LLC, a Kentucky limited liability company ("Enzonic," "we," "us," or "our"), including the Enzonic Cloud game and application server hosting platform available at cloud.enzonic.com or enzonic.com(the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service you represent that you have the legal capacity to enter into a binding agreement.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at admin@enzonic.com if you suspect unauthorized access.

3. Acceptable Use

You agree not to use the Service to:

• Host or distribute malware, viruses, or other malicious code.
• Conduct denial-of-service (DoS/DDoS) attacks against any system.
• Mine cryptocurrency or run resource-intensive workloads unrelated to game or application hosting.
• Infringe any third-party intellectual property, privacy, or other rights.
• Violate any applicable local, state, federal, or international law or regulation.
• Resell or sublicense access to the Service without prior written permission.

Violation of these rules may result in immediate suspension or termination of your account without refund.

4. Payment and Billing

The Service uses a prepaid credit system and optional monthly recurring subscriptions. Credits are purchased in advance and consumed based on actual resource usage. Prices are displayed on the pricing page and in your dashboard. We reserve the right to adjust pricing with at least 7 days' notice.

All payments are processed through third-party payment processors (e.g. Stripe). By providing payment information you authorize us to charge the stated amounts. Credits are non-refundable except as required by applicable law.

5. Subscriptions

Paid subscription plans (e.g., Enzonic Plus, Enzonic Premium) are billed on a recurring basis. You may cancel your subscription at any time through your billing dashboard. Cancellation takes effect at the end of the current billing period; no partial-period refunds are issued.

6. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance that temporarily affects availability. We are not liable for any losses arising from downtime or service interruptions.

7. Data and Backups

You are solely responsible for maintaining backups of data stored on servers provisioned through the Service. We may perform platform-level backups for operational purposes but do not guarantee data recovery.

8. Intellectual Property

All content, trademarks, and software comprising the Service are owned by Enzonic LLC or our licensors. You retain ownership of data you upload or create. You grant us a limited license to host and process your data solely to provide the Service.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or any reason we deem necessary to protect the integrity of the Service or other users. Upon termination, your right to use the Service ceases immediately.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ENZONIC LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless Enzonic LLC and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Kentucky.

14. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Reseller Cloud Platform Terms

If you participate in or deploy services through the Enzonic Reseller Cloudprogram ("Reseller"), you agree to the following additional covenants:

• White-Label & Sub-Account Responsibility: You are solely responsible for all activities, billing, end-user support, and content uploaded by your sub-accounts, customers, and team members. You must maintain and enforce your own Terms of Service and Privacy Policy that are at least as protective of Enzonic and its network as these Terms.
• Pass-Through Acceptable Use: You must not permit your customers to engage in any prohibited activities described in Section 3 (including DDoS stress testing, botnets, crypto-mining, malicious proxy networks, or copyright infringement). You must promptly investigate abuse reports forwarded by Enzonic within 24 hours.
• Platform Cut & Compute Fees: Enzonic levies a platform infrastructure fee and percentage cut on standard and premium compute nodes as established in the Reseller Portal. Base infrastructure fees for active provisioned servers are charged automatically.
• BYO Wings Daemon Nodes: If you connect custom compute nodes via Calagopus Wings, you represent that you own or have authorized access to the underlying hardware/virtual machines and assume full responsibility for the security, stability, and integrity of your daemon installations.
• White-Label Branding: The "Powered by Enzonic" attribution tag must remain visible on all public storefronts and client portals unless your store maintains an active Reseller Pro subscription.
